About these terms
These terms govern your use of ASTERKIND and orders placed through this website. The legal seller is ASTERKIND . By submitting an order, you agree to these terms, the Privacy notice, Shipping policy and Returns & refunds policy.
If you do not agree, do not submit an order. Nothing in these terms excludes a consumer right or remedy that cannot lawfully be excluded.
Eligibility
You must have legal capacity to enter a purchase contract. If you are under the age of majority where you live, a parent or legal guardian must place the order. The store currently supports delivery only to eligible United States addresses.
Checkout is intended for individual consumers purchasing for personal or household use. We may decline an order that appears to be placed by a reseller, exporter, purchasing agent or automated buyer, or that exceeds a reasonable household quantity. Contact customer care before attempting a genuine business or bulk purchase; no bulk order is accepted until separately confirmed in writing.
Products and availability
We aim to present product names, descriptions, materials, care information, measurements, colors, images and prices accurately. Screen and lighting settings can affect color appearance, and measurements may have reasonable manufacturing variations.
Products and variants remain subject to availability. Placing an item in the shopping bag does not reserve it. A time-limited inventory reservation begins when the order is created and may expire if payment is not completed.
Prices, promotions and taxes
Prices are displayed in U.S. dollars. Delivery charges, discounts and any tax collected by the store are shown before you continue to PayPal. Promotions may have separate eligibility, timing and return conditions disclosed with the offer.
Unless the promotion expressly says otherwise, offers are limited to the stated period, cannot be combined, have no cash value and do not apply retroactively. We do not currently offer customer accounts, loyalty points, referral credits or store gift cards through this website. A reference to such a feature on an unaffiliated site does not create an obligation for ASTERKIND.
If a price, description or promotion contains an obvious error, we may correct it before accepting the order. If payment has already been captured, we will ask whether you wish to proceed on the corrected terms or cancel and receive a refund. We will not substitute a materially different item without your agreement.
Checkout and payment
You are responsible for reviewing the products, quantities, address, delivery method and total before payment. Information submitted at checkout must be complete and accurate.
Payment is processed by PayPal. Available PayPal, card and wallet options depend on PayPal, the buyer and location. PayPal’s terms, privacy practices, risk checks and account rules apply separately. ASTERKIND does not receive your PayPal password or complete card or bank credentials.
Order acceptance and cancellation
Submitting an order is an offer to purchase. A payment authorization, capture, order number or automated acknowledgement does not by itself mean the order has been accepted. Unless applicable law requires otherwise, acceptance occurs when we confirm dispatch.
Before dispatch, we may reject or cancel an order for unavailable inventory, incorrect price or product information, failed payment, suspected fraud, checkout misuse, delivery restrictions or legal requirements. If payment was captured, the applicable amount will be refunded to the original payment method.
If you request cancellation, we will try to stop fulfillment but cannot guarantee cancellation after processing has begun. Your return rights remain available after delivery where the item qualifies.
Shipping and delivery
Available destinations, charges, processing estimates and carrier estimates are described in the Shipping policy. Delivery dates are estimates unless expressly stated as guaranteed.
If we cannot ship within the stated time, we will provide legally required notice and, where required, ask whether you agree to the delay or prefer cancellation and a refund. You are responsible for providing a deliverable address and promptly reporting an address error.
Unless applicable law provides otherwise, risk of loss passes when the order is delivered to the address supplied at checkout. Title passes when full payment is received and delivery is completed.
Returns and refunds
Return eligibility, exclusions, shipping responsibility, inspection, refund amounts and timing are described in Returns & refunds. Refunds are sent to the original payment method. Nothing in the return policy limits rights that apply to faulty, damaged, misdescribed or incorrectly supplied goods.
Customer communications
We may provide transaction information through the website, PayPal, email or the customer-care channel associated with the order. Keep your contact information accurate and review communications about shipping delays, returns or refunds. Do not send payment credentials to customer care.
You consent to receive electronic records that are necessary to complete and service an order. Transactional messages are not marketing consent. Save or print the policies and order summary for your records. If applicable law requires a paper copy or another format, contact customer care.
Customer submissions and feedback
Information, photographs or documents sent for order support, a return, accessibility feedback or a legal request must be accurate, lawful and limited to what is reasonably necessary. Do not send content that infringes another person’s rights or contains malware, payment credentials or unrelated sensitive information.
You retain ownership of your submission. You give the seller and its service providers a non-exclusive license to copy, store, review and disclose it only as reasonably necessary to address the request, operate and secure the service, comply with law or establish and defend legal claims. We do not currently publish customer reviews or user submissions on the website.
General product or service feedback may be used without payment or attribution, but this does not transfer ownership of confidential information or personal information. Do not submit an idea under an expectation of confidentiality or compensation unless a separate written agreement has been signed.
Acceptable use
You may use the website for lawful personal shopping and customer-care purposes. You must not:
- interfere with the website, security controls, inventory or checkout;
- attempt unauthorized access or use another person’s information without authority;
- submit fraudulent orders, payment disputes or return claims;
- introduce malware, automate abusive traffic or scrape protected content at scale;
- copy or exploit ASTERKIND branding, product content or software without permission; or
- use the service in violation of law or another person’s rights.
We may restrict access, cancel an unpaid order or preserve evidence where reasonably necessary to protect the service or investigate misuse.
Intellectual property
The website design, text, graphics, product presentation, branding and software are owned by or licensed to the seller and are protected by applicable intellectual-property laws. You may view the website and keep order records for personal use. No other license is granted.
“ASTERKIND,” its presentation and related source identifiers may not be used in a way that suggests endorsement, affiliation or source without permission. Product names or third-party marks remain the property of their respective owners. Procedures for reporting suspected infringement are described in Legal notices.
Third-party services and links
PayPal, carriers and linked third-party sites operate under their own terms and privacy notices. We are responsible for our obligations as seller, but we do not control a third party’s account eligibility, independent content or systems.
Service availability
We may maintain, change or temporarily suspend the website. We do not promise that every feature will be uninterrupted or error-free. This does not affect an accepted order or legal obligation that continues despite a website outage.
We are not responsible for delay caused by circumstances outside reasonable control, such as carrier disruption, severe weather, natural disaster, labor dispute, utility or network failure, government action, epidemic, war or civil unrest. This provision does not permit us to retain payment for goods we are legally required to refund or remove rights relating to delayed shipment.
Trade controls
You may not use the website or purchase goods in violation of applicable sanctions, export controls or other trade restrictions. You represent that you are not using a prohibited destination, party or transaction. We may reject, hold or cancel an order where reasonably necessary for legal compliance and will handle captured funds as required by law.
Liability
To the extent permitted by law, we are not liable for losses that were not reasonably foreseeable when the purchase contract was formed, or for business losses arising from a consumer purchase. We do not exclude or limit liability where doing so would be unlawful, including liability for fraud, willful misconduct, death or personal injury caused by negligence, or mandatory rights relating to defective goods.
Disputes and applicable law
Use contact & order help first so we can try to resolve an order issue. These terms are governed by the laws that apply to the seller and the transaction, without depriving you of mandatory protections that apply where you live. You may use any court, regulator, payment dispute process or other remedy available under applicable law.
These terms do not require confidential arbitration or waive participation in a class or representative proceeding. Any future dispute-resolution provision will apply only as permitted by law and only after the legally required notice and assent.
General provisions
If a provision is unlawful or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue. A delay in enforcing a right is not a waiver. We may assign these terms as part of a legitimate transfer of the business; you may not assign an order or claim in a way that prejudices our rights or another person’s rights.
These terms and the policies incorporated by reference are the complete website purchase agreement, except for a promotion or written agreement that expressly supplements them. Headings are for convenience. Provisions that by their nature should continue—including payment, intellectual property, liability, dispute and recordkeeping provisions—survive termination or completion of an order.
Changes and contact
The version posted when you submit an order applies to that order. We may update these terms prospectively when the store, services or legal requirements change.
